La monografia è divisa in tre parti. La prima è dedicata a una ricostruzione diacronica della giurisprudenza costituzionale sul tema dei rapporti tra il principio/diritto alla libera manifestazione del pensiero e i reati cc.dd. di opinione. La seconda prende in esame la dottrina italiana di matrice costituzionale e penalistica sullo stessa tema, dal dopoguerra a oggi. La terza, a sua volta, è suddivisa in tre aree specifiche, rispettivamente: le restrizioni penalistiche al discorso razzista, al discorso blasfemo e a quello negazionista.
The Limits to Free Speech on Social Media : On Two Recent Decisions of the Supreme Court of Norway

In January 2020, two persons in Norway were condemned by a unanimous Supreme Court of Norway for comments posted on ‘closed’ Facebook groups. With the two decisions, the Supreme Court confirmed for the first time the boundaries of hateful, racist, and discriminatory speech in the context of online utterances in social media. Il testo prende spunto dalla decisione del Tribunale di Torino, che ha riguardato il noto scrittore Erri De Luca, per chiarire e mettere a punto alcuni profili della teoria dell’istigazione a delinquere e i rapporti di questa con la libertà d’espressione. By commenting on the decision given by the Tribunal of Turin in the case of the renowned writer Erri De Luca, the paper clarifies some controversial aspects of the criminalization of the conduct of public encouragement to crime, as well as its relationships with the right to free speech.

Starting from the premise that digital society and advances in technology determine the need for adaptation, even if only in an interpretative sense, of the legal categories of constitutionalism, the study analyzes the new dimension of the freedom of expression of thought in the "digital environment". In this article, starting with the exemplary case of Charlie Hebdo, we discuss the way in which the theme of laughter is intertwined with that of freedom of expression. More precisely, we try to answer the following questions: how can the comic framework modify the space of freedom of expression? Can everything be said within this kind of framework? Can laughter be both an antidote and an enhancer of verbal violence?
